One of my important early cases in Indiana was successfully defending a battered woman accused of murder. As previously mentioned, my client’s murder charges acquittal was the first of its kind. It is a sad reality that couples will sometimes move from intimacy to anger to physical violence. Domestic violence can involve current or former spouses, current or former girlfriends or boyfriends, or current or former domestic partners. Physical abuse may also involve children. The Family Abuse Prevention Act (FAPA) restraining order states that the accused abuser must leave the petitioner and their children alone. It will also require the accused to leave the home of the petitioner if they cohabitate.
